TÉRMINOS Y CONDICIONES

IMPORTANTE: al realizar un encargo, el Cliente garantiza que ha leído, comprendido y aceptado todos estos términos.

Tanto la información como los presupuestos que aparecen son para encargos personales. En caso de querer un trabajo para uso comercial (ya sea para videojuegos, productos, entre otros) contactar conmigo directamente a través del correo marganbrella[@]gmail.com para hablar sobre los detalles y el presupuesto.Además, solamente se aceptarán encargos realizados a través del formulario habilitado para ello. Las peticiones realizadas mediante otra vía serán ignoradas. Pero cualquier duda que pudiera haber al respecto, puede ser realizada mediante correo electrónico o los mensajes directos de Twitter e Instagram.

▶ CONDICIONES

▸ El Cliente deberá ser mayor de edad.▸ El pago se realizará vía PayPal.▸ Se abonará el 50% del precio final del encargo por adelantado.▸ El encargo se empezará una vez se haya realizado el pago.▸ Solo se aceptarán pagos en Euros (€).▸ El pago no será reembolsado a no ser que no se haya empezado a trabajar en el encargo. Después del comienzo de la etapa de boceto no se realizará ningún reembolso.▸ Si el encargo se quiere en un tiempo menor al estimado, puede darse un incremento sobre el precio base.▸ Los encargos serán solamente digitales (ni tradicional ni impresiones).▸ El Cliente se compromete a enviarle a la Ilustradora toda aquella información y recursos necesarios para la realización del encargo.▸ Si el Cliente tarda más de dos semanas a la hora de cerrar un encargo, dicho encargo será denegado. Además, si para la aprobación de una de las etapas el Cliente tarda más de dos semanas (sin ninguna notificación previa), también se cancelará el encargo sin ningún tipo de reembolso.▸ Si el encargo está pensado para un tamaño específico (ya sea para una impresión, banner, etcétera), las medidas deberán ser comunicadas en el momento de realizar el encargo. Así como las diferentes versiones que se puedan necesitar de la misma pieza, incluido el formato.▸ Cualquier atraso en la entrega será notificado al Cliente en la mayor brevedad posible.▸ Queda a criterio de la Ilustradora aceptar o no un encargo.▸ No se realizan NFTs y su uso para tales fines está prohibido.▸ Queda prohibido su uso para todo aquello que tenga relación con IA.

▶ REVISIONES

Se incluirán 3 revisiones gratuitas, una en cada etapa (una en la etapa de boceto, una en la etapa de línea y color y una en la etapa de render). Si en las dos últimas etapas las revisiones suponen cambios mayores, o si se quieren más revisiones, estos cambios serán cobrados aparte. Así como cualquier añadido posterior también será cobrado aparte, y su precio irá en función de lo que suponga dicho añadido.El Cliente debe realizar una inmediata objeción de si el trabajo sigue las pautas acordadas o no, puesto que pasada la fase de boceto se entiende que el encargo se está realizando correctamente de acuerdo a los criterios del Cliente y no se harán cambios de este tipo de ahí en adelante.

▶ COPYRIGHT

El copyright del encargo pertenece a la Ilustradora, no al Cliente. Al Cliente le pertenece el derecho de reproducir el encargo únicamente para uso personal. Esta licencia es personal del Cliente por lo que no podrá ser transferida a terceros sin consentimiento de la Ilustradora.Además, la Ilustradora podrá usar cualquier imagen que haya creado para autopromocionarse. Si el Cliente no quisiera que su obra fuese usada de tal modo, deberá dar sus razones en el momento de realizar el encargo, ni durante ni después.El uso comercial no estará permitido (o cualquier uso fuera del acordado, incluyendo NFT, IA) así como cualquier modificación del encargo. En dicho caso, la creadora tendría el TOTAL derecho a reclamar el 100% de los beneficios NO autorizados. Además, la copia, trazado, calco, borrado de la firma o uso de los encargos sin consentimiento de la Ilustradora, supone una infracción de derechos de autor.

TABLA DE PRECIOS

IMPORTANTE: los precios presentados son orientativos. Pueden variar en función de la complejidad y el nivel de detalle que se quiera en el encargo.

IMPORTANT: by placing an order, the Customer warrants that he/she has read, understood and accepted all these terms.

The information and the budgets that appear are for personal commissions. If you want a work for commercial use (for videogames, products, among others) contact me directly through the email marganbrella[@]gmail.com to discuss details and budget.In addition, I will only accept orders made through the form provided for this purpose. Requests made by any other way will be ignored. But any inqueries can be made via email or direct messages on Twitter and Instagram.

▶ CONDITIONS

▸ The Customer must be over 18 years old.▸ Payment shall be made via PayPal.▸ The 50% of the final price of the order will be in advance.▸ The order will be started once payment has been made.▸ Only payment in Euros (€) will be accepted.▸ The payment will not be refunded unless work has not started. After the start of the sketching stage, no refund will be made.▸ If the commission is wanted in less time than the estimated time, there may be an increase in the base price.▸ The commissions will be digital only (neither traditional nor printed).▸ The Client undertakes to send the Illustrator all the information and resources necessary for the completion of the assignment.▸ If the Client takes more than two weeks to complete an order, the order will be rejected. In addition, if the Client takes more than two weeks (without any prior notification) for the approval of one of the stages, the order will also be canceled without any refund.▸ If the order is intended for a specific size (whether for a print, banner, etc.), the measurements must be communicated at the time the order is placed. As well as the different versions of the same piece that may be required, including the format.▸ Any delay in delivery will be notified to the Client as soon as possible.▸ It is at the Illustrator's discretion whether or not to accept an order.▸ NFTs are not carried out and their use for such purposes is prohibited.▸ It is prohibited to use it for anything related to AI.

▶ REVISIONS

3 free revisions will be included, one in each stage (one in the sketch stage, one in the line and colour stage and one in the render stage). If in the last two stages the revisions involve major changes, or if more revisions are desired, these changes will be charged separately. Any subsequent additions will also be charged separately, and will be priced according to the amount of such additions.The Client must make an immediate objection as to whether the work follows the agreed guidelines or not, since after the sketch phase it is understood that the commission is being carried out correctly according to the Client's criteria and no changes of this type will be made thereafter.

▶ COPYRIGHT

The copyright of the assignment belongs to the Illustrator, not to the Client. The Client has the right to reproduce the assignment for personal use only. This license is personal to the Client and may not be transferred to third parties without the consent of the Illustrator.Furthermore, the Illustrator may use any image she has created for self-promotion. If the Client does not wish his work to be used in such a way, he must give his reasons at the time of commissioning, neither during nor after.Commercial use is not permitted (or any use outside of that agreed, including NFT, AI) as well as any modification of the commission. In such a case, the creator would have the FULL right to claim 100% of the NOT authorized profits. In addition, copying, tracing, erasing the signature, or use of the commissions without the Illustrator's consent is an infringement of copyright.
